Apple drops the iPhone NDA

Let the leaks begin. :)

Apple:

We have decided to drop the non-disclosure agreement (NDA) for released iPhone software.

We put the NDA in place because the iPhone OS includes many Apple inventions and innovations that we would like to protect, so that others don’t steal our work. It has happened before. While we have filed for hundreds of patents on iPhone technology, the NDA added yet another level of protection. We put it in place as one more way to help protect the iPhone from being ripped off by others.

However, the NDA has created too much of a burden on developers, authors and others interested in helping further the iPhone’s success, so we are dropping it for released software. Developers will receive a new agreement without an NDA covering released software within a week or so. Please note that unreleased software and features will remain under NDA until they are released.

Are there really iPhone specific patents? What kind of things could be patented regarding the iPhone? And yes, that is a proper question, not a snarky comment.

Um....Ok, so this solves practically nothing except that it quelches innovation that allows a developer to build a better fanboi trap. Unfortunately for Apple ;) , it doesn't prevent all the Meizu's of the world to release something that looks identical to OS X "Nano".

That letter from Apple is simply a facade. The NDA was always designed to stop Apple from being embarrassed in the media with regard to its draconian treatment of developers.

One of the thorns of iphone developing is gone. Apple probably reacted to the bad press recently and to the growing criticism of developers. That was stupid that a dev could not get help from another one because of that NDA. Talk about being dev friendly !

Daveinla: The developers still working on their applications using the SDK are still under the Effin' NDA which prohibits them from talking to other developers. What the eff changed exactly? This move is window dressing. The boogieman is gone !! Nuh-huh !!

Have you actually used a Windows Mobile device? For one, the Today screen is incredibly easy to get access to programs because it presents a daily list of information such as phone calls, appointments, new messages (which include summaries of those messages), reminders, and other stuff. Clicking on your information loads the appropriate program, not the other way around. There's a whole market for just Today Screen plugins and add-ons. It's sure better than having to launch app after app to try to find that info based on a number overlayed over a particular icon, having each app close while loading another one. Clicking "Programs" on a WM Smartphone opens up an icon view of installed programs - just like the Home button on the iPhone. The iPhone is program-centric, not task-centric, which is the way Windows Mobile, as well as Windows Mobile users work. I guess that's why they're accepted in the workplace more than the iPhone - WM users get work done while iPhone users are playing with their accelerometers. (sic) And BTW: There is no mouse arrow on Windows Mobile. I guess that does make you an iMoron.

How does Apple get away with these unnecessary terms? can they really expect people to sit by and let them kill off 3rd-party competitive innovation within their own space? Apple should really lay off putting restrictions on programmers, and just let them enhance the user experience beyond what Apple is willing to do. ;)

To be fair, I jailbroke my 3G, and mucked around with a couple of Cydia and Installer packages, and I have to say Apple's official apps are so much more polished (if only a little vapid) than the numerous hack jobs on Cydia. Several apps I installed screwed up the phone, so much so that the phone.app was unusable (irresponsive to touch). I unjailbroke my phone again. If only Apple would let people build whatever applications they want, but rather approve or disprove apps solely based on their adherence to UI and UX principles, I would be OK with their oversight.

What?! No posts about Windows Mobile 7 being delayed so that Microsoft can do exactly what Steve Jobs is saying in this memo about the NDA? That Microsoft steal from others, it's happened before, and it's actually happening right now by the Windows Mobile 7 team? That's why they aren't releasing it until sometime in 2010.

Ah, poor Apple. The press is starting to turn against them, so they had to do something. All of the gloom and doom of the Mac Fans that Microsoft going down is not happening. The new Servers are being met with critical praise and Windows Seven is looking impressive. Meanwhile to help silence further commentary on the Year of the Apple Epic Fail, they scrap the NDA for published apps. (Golf clap.) Developer friendly? I know from listening to actual developers that they disagree strongly. Those at non-Apple sponsored development conferences were on camera saying that the NDA, before or after an app is launch was hurthing them. So it really isn't so friendly at all, Apple's just overreatcing to how Microsoft legally obtained the GUI. Its like Gates and Ballmer got into their heads and they're like an scarred victim overreating. I think we're finally seeing Apple for what it is. Microsoft in the 1990's. Part monopolist and opportunist looking out more for its own interests and not the consumer good. I am not saying that they don't make good products. This year we've seen the ugly side of Apple and it is well deserved criticism. On the converse, Microsoft has an ugly side that nobody likes. However, Microsoft going through so much littigation, has taught them some valuable lessons. They are definitely pulling away from Apple and I see them as gaining maturity at this point.

BTW, yes, Microsoft, like every other company (including Google, go figure) has an evil side to it. That's not hard to believe when companies like Fannie Mae, which were created to help the people did stupid things too.

What struck a nerve was that bettie misunderstood one of my earlier posts and instead of seeking clarification, chose to go on the name-calling route instead. And it wasn't like there was much scope for misunderstanding it, but somehow, bettie decided I was insulting him and decided to go for stronger insults to counter attack. Harmless comment, taken out of context and used as an excuse for attacks. Anyway, I realize yesterday's rant against bettie was a little childish and apologize for it.

One more thing. I like my iPhone and have no problems with it. It was a gift but my wife knew I wanted it. But here's the thing....I wanted because of what I read at Winsupersite, from reading the review and the blog. Go figure. But then again, Iinstalled Leopard as well as Vista , on my Mac because of what I read at Winsupersite, and now use Exchnageto it's fullest and other free cloud stuff. So thanks everyone for letting me leach off your knowledge. I get a few good laughs from here too! Good stuff!

Shark, I do remember the post, and I know you did not call him/her/it/they/whatever a socialist. I'm not getting at you at all. I just find it kind of amusing that the term "socialist" could be taken as offensive. For example, if i speak on the phone, people often assume (incorrectly) my nationality, or completely mis-pronounce my name. I don't get offended, I laugh a little, and correct them. If someone called me a socialist, capitalist, communist, marxist, (or even repuplican, or a democrat - which means nothing to me!) I don't think I could take offence if I tried. Strange. Anyway, about the projects already started under the apple NDA, is there anything preventing developers from 'scrapping' their projects, and then starting again, to get current development out of the NDA loop?
